The 2007 Heartland Car Wash Association Products & Equipment Show will take place April 20 - 21, 2007 at Adventureland Palace Theatre. Members will be receiving show registration forms in February. Please make your arrangements to attend 2007 HCA Trade Show.
>> LEGISLATURE AMENDS CAR WASH EQUIPMENT TAX ISSUE
Governor Vilsack has signed into law a bill that excludes car wash equipment as being taxed as real estate in Iowa. All car wash owners should check with their local assessors in regards to making sure that their car wash equipment is not included in their current assessments. This change to Chapter 427 of the Iowa Code is retroactive to January 1, 2006. If car wash owners in Iowa have any questions, they should contact the HCA office for further details. The exact text of the bill is as follows:
Section 427A.1, Code 2005, is amended by adding the following new subsection:
NEW SUBSECTION. 5A. Notwithstanding the other provisions of this section, property that is equipment used for the washing, waxing, drying, or vacuuming of motor vehicles and point-of-sale equipment necessary for the purchase of car wash services shall not be assessed and taxed as real property.
>> COURT RULES ON CAR WASH EQUIPMENT TAX ISSUE
An
Iowa district court judge has found that automatic car washing equipment
including vacuums, computers, water softeners, hot water storage
tanks, boilers, compressors, washing machinery in individual wash
bays, dryer systems, pump stations and the exposed piping and hoses
that serve those items should not be included in the taxed assessed
value of a car wash for property tax purposes. The same court,however,
also found that the car wash's collection pits, underground tank,
interior plumbing, gas transmission lines and electrical transmission
lines would be considered a structure or improvement and therefore
could be taxed as real property.
Individual
car wash owners may wish to consult legal counsel if they believe
their current assessments are materially at odds with the above
ruling.
